ABC denies permit appealHoxie resident Kerry Nicholas' plans to open a convenience store in the Shady Grove community received another setback on Dec. 19 when the Alcohol Beverage Control Division denied an appeal of ABC Director Michael Langley's decision to not allow the proposed store to sell beer.
Nicholas has stated that he will not build the store if he is not allowed to sell beer.
Shady Grove is located on a small sliver of Greene County sandwiched between Lawrence County and Craighead County on Highway 63. Greene County Sheriff Dan Langston attended the appeal hearing and voiced his opposition to the permit.
His reasons included difficulty in providing law enforcement services to the remote section of the county and concerns raised by nearby residents.
The board voted 4-1 to dismiss the appeal.
The only remaining avenue for Nicholas would be to file a lawsuit against the ABC Division in circuit court.
